Pet Laws
Below are some of the ordinances relating to animals kept within the limits of the City of Fitzgerald. The entire municipal code for animal control can be viewed through Municode. You may also search by specific ordinance number.
chained or tethered animals
It shall be unlawful for any person owning and/or controlling dog(s) or cat(s), whether vaccinated or unvaccinated, licensed or unlicensed, to leave dog(s) or cat(s) or to allow said dog(s) or cat(s) to be chained or tethered. Ordinance #02-1303
adequate shelter
It shall be unlawful for any owner(s) to keep, use, or maintain dog(s) or cat(s) on any premises unless the dog(s) or cat(s) is provided adequate shelter. Ordinance #02-1303
enclosure
Any dog confined within an enclosure other than the owner’s dwelling must have exercise space of at least one hundred square feet, have all sides enclosed and be of sufficient height to prevent the dog from escaping from the enclosure. Ordinance #02-1303
animal limits
It shall be unlawful for any person to own, harbor or keep more than four (4) dogs and cats of six (6) months of age or older, of which no more than two (2) of said animals shall be dogs, or three (3) of said animals shall be cats. Ordinance #02-1303
pit bulls or pit bull dogs
As of November 14, 2011 no pit bull dog shall be sold, purchased or otherwise obtained within the corporate limits of the City of Fitzgerald or otherwise brought into the City of Fitzgerald. Ordinance #11-1432
dangerous dog
Dangerous dog means any dog that a) has chased a person or without provocation, behaved in a manner that caused a person to reasonable believe that the dog posed an imminent threat of serious injury or death to that person or a child in that person’s charge, b) while off the owner’s property has seriously injured, killed, or more than once endangered the safety of a domestic animal; provided, however, that this subparagraph shall not apply where the injury or damage inflicted by the dog was sustained while the dog was working or training as a hunting dog, herding dog, or predator control dog; or c) has been similarly classified by an animal control authority or court of another jurisdiction where the classifications was a result of the dog’s actions.
